Waste Collection Putney Service Terms and Conditions
These Terms and Conditions set out the basis on which Waste Collection Putney provides waste collection and related services to residential and commercial customers. By booking any service, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.
1. Definitions and Scope of Service
In these Terms and Conditions, the following expressions have the meanings given below:
Customer means the person, company, or organisation requesting and paying for the services.
Services means any waste, refuse, rubbish, junk, recycling, or bulky item collection, loading, transportation, and disposal carried out by Waste Collection Putney, including any related services agreed in writing.
Waste means any items, materials, or goods presented for removal, including household waste, commercial waste, garden waste, recyclable materials, and bulky items, excluding any prohibited or hazardous materials as defined in these terms.
Agreement means the binding contract between Waste Collection Putney and the Customer, consisting of these Terms and Conditions and the confirmed booking details.
Waste Collection Putney provides waste collection and disposal services primarily within Putney and surrounding areas. The Company reserves the right to refuse service in locations that are not reasonably accessible or where it is unsafe or unlawful to operate.
2. Booking Process
2.1 The Customer may request a booking by telephone, email, online form, or other communication channel made available by Waste Collection Putney. All bookings are subject to availability and confirmation by the Company.
2.2 At the time of booking, the Customer must provide accurate and complete information, including but not limited to:
• Full name and contact details
• Service address and any access instructions
• Type and approximate quantity or volume of waste
• Any time constraints or preferred collection window
• Details of any potentially hazardous, heavy, or unusually bulky items.
2.3 Waste Collection Putney may provide a quotation based on the information supplied. Quotations may be given as a fixed price or as an estimate based on expected waste volume or type. The Company reserves the right to adjust the price if the actual waste differs from the description provided.
2.4 A booking is considered confirmed only when Waste Collection Putney issues a confirmation by email, message, or verbal confirmation, and the Customer accepts any stated charges, time slots, and conditions.
2.5 The Customer is responsible for ensuring that any person present at the property and giving instructions to Waste Collection Putney on the day of service is authorised to do so on the Customer’s behalf.
3. Access and Service Conditions
3.1 The Customer must ensure that the collection point is safe and accessible for the Company’s staff and vehicle. This includes providing clear access, free from obstructions, and ensuring that parking is available where required.
3.2 If special access arrangements are needed, such as key codes, entry via concierge, or restricted access times, the Customer must inform Waste Collection Putney at the time of booking.
3.3 If the Company cannot carry out the service due to lack of access, incorrect address details, unsafe conditions, or the presence of prohibited waste, the Company may charge a call-out or wasted journey fee.
3.4 The Customer warrants that all waste presented for collection is owned by the Customer or that the Customer has full authority from the owner to request its removal.
4. Payments and Charges
4.1 Prices are stated in pounds sterling and are inclusive or exclusive of VAT as indicated at the time of booking. Waste Collection Putney reserves the right to amend its prices at any time, but changes will not affect confirmed bookings unless the service scope changes.
4.2 Payment terms will be confirmed at the time of booking. Unless otherwise agreed, payment is due immediately upon completion of the service or in advance where required.
4.3 Waste Collection Putney may accept payment by cash, debit card, credit card, bank transfer, or other methods notified to the Customer. The Company is not obliged to commence or continue services if valid payment details are not provided or payment is declined.
4.4 For commercial customers, credit accounts may be offered at the sole discretion of the Company, subject to credit checks and agreed terms. If a credit account is granted, invoices are payable within the period stated on the invoice. Late payment may incur interest and recovery costs as permitted by law.
4.5 If the quantity or type of waste presented on the day differs from that described at booking, the Company may:
• Adjust the price to reflect the actual load size and disposal costs; or
• Refuse to remove additional or different waste; or
• Remove part of the waste up to the agreed price.
In such cases, the Customer will be informed of any change in price before the work continues.
5. Cancellations and Amendments
5.1 The Customer may cancel or amend a booking by contacting Waste Collection Putney during normal business hours.
5.2 If the Customer cancels more than 24 hours before the scheduled collection time, no cancellation fee will normally apply, unless otherwise stated at the time of booking.
5.3 If the Customer cancels less than 24 hours before the scheduled collection, or fails to be available at the agreed time, the Company may charge a cancellation or wasted journey fee up to a reasonable proportion of the quoted service price.
5.4 Waste Collection Putney reserves the right to cancel or reschedule a booking due to reasons beyond its reasonable control, including but not limited to vehicle breakdown, staff illness, extreme weather, traffic conditions, or legal restrictions. In such circumstances, the Company will use reasonable efforts to notify the Customer and arrange a new appointment. The Company will not be liable for any indirect loss arising from such cancellation or delay.
6. Customer Responsibilities
6.1 The Customer must segregate waste where required by law or as instructed by the Company, particularly recyclable materials and restricted items.
6.2 The Customer must not present for collection any waste that is hazardous, explosive, corrosive, flammable, or otherwise dangerous, including but not limited to asbestos, gas bottles, certain chemicals, oil, paint in liquid form, clinical or medical waste, or electrical items that are restricted under applicable regulations, unless specifically agreed in advance and compliant with law.
6.3 Any sharp or dangerous items must be safely contained and clearly identified to protect staff and third parties.
6.4 The Customer must ensure that there are no valuables or personal items mixed with the waste. Waste Collection Putney is not responsible for any item removed as waste that the Customer intended to keep.
6.5 The Customer shall indemnify Waste Collection Putney against any claim, cost, or liability arising from breach of these obligations, including improper presentation of hazardous or prohibited waste.
7. Performance of Services
7.1 Waste Collection Putney will use reasonable skill and care in performing the services. The Company aims to arrive within agreed time slots but does not guarantee exact times due to the nature of waste collection, traffic, and external conditions.
7.2 On arrival, staff will inspect the waste and may adjust the quotation if the description materially differs. If the Customer does not accept any revised price, the Company may refuse to proceed and may charge a reasonable call-out fee.
7.3 The Company’s staff may, at their discretion, assist with reasonable loading from within the property, garden, or outbuildings, provided it is safe and lawful to do so. The Customer must ensure clear access routes and a safe working environment.
8. Waste Handling and Regulations
8.1 Waste Collection Putney will transport and dispose of waste only at authorised facilities and in accordance with applicable environmental and waste management legislation in the United Kingdom.
8.2 The Company will hold and maintain any licences, permits, or registrations required for its operations, including waste carrier registration where applicable.
8.3 Ownership of waste transfers from the Customer to Waste Collection Putney at the point the waste is loaded onto the Company’s vehicle, subject to the waste being lawful to carry and dispose of. If the waste is later found to be prohibited, misdescribed, or hazardous contrary to the Customer’s declarations, the Customer may remain responsible and liable for any resulting costs or enforcement action.
8.4 Where practicable, Waste Collection Putney will seek to reuse, recycle, or recover materials in preference to disposal to landfill, in line with waste hierarchy principles, but offers no guarantee as to the final treatment route for specific items.
9. Liability and Limitations
9.1 Nothing in these Terms and Conditions limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other matter that cannot be excluded under applicable law.
9.2 Subject to the above, Waste Collection Putney will not be liable for:
• Any indirect or consequential loss or damage;
• Loss of profit, revenue, or business opportunity;
• Loss of data or information;
• Any loss arising from delays or cancellations beyond the Company’s reasonable control.
9.3 The Company’s total liability to the Customer in respect of any claim arising out of or in connection with the services, whether in contract, tort, or otherwise, shall not exceed the total amount paid or payable by the Customer for the specific service giving rise to the claim.
9.4 The Customer is responsible for protecting floors, surfaces, and fixtures where waste is being moved from within a property. While the Company will take reasonable care, minor scuffs or marks may occur during removal of bulky items. Waste Collection Putney is not liable for cosmetic or minor damage arising from reasonable performance of the services unless caused by negligence.
9.5 The Customer must notify the Company of any damage or issue arising from the service within 48 hours of completion. Failure to do so may prejudice the Company’s ability to investigate and may affect any potential remedy.
10. Insurance
10.1 Waste Collection Putney will maintain appropriate public liability insurance and, where applicable, employer’s liability insurance, in accordance with legal requirements and industry practice.
10.2 Evidence of insurance cover may be provided to the Customer upon reasonable request.
11. Complaints and Dispute Resolution
11.1 If the Customer has a complaint regarding any aspect of the services, they should contact Waste Collection Putney as soon as possible, providing full details and any relevant evidence.
11.2 The Company will investigate complaints promptly and aim to resolve issues through discussion and, where appropriate, remedial action or a goodwill gesture. Any remedy will be at the Company’s discretion, subject to these Terms and Conditions and applicable law.
11.3 If a dispute cannot be resolved directly, the parties may consider alternative dispute resolution methods, but nothing prevents either party from commencing court proceedings where appropriate.
12. Data Protection and Privacy
12.1 Waste Collection Putney will collect and use personal information about the Customer to manage bookings, perform services, process payments, and communicate about services.
12.2 The Company will handle personal data in accordance with applicable data protection laws in the United Kingdom. Customer details will not be sold to third parties and will only be shared where necessary to provide the services, comply with the law, or where the Customer has given consent.
13. Changes to Terms and Conditions
13.1 Waste Collection Putney may amend these Terms and Conditions from time to time. Updated terms will be published or otherwise made available, and will apply to new bookings from the date of publication.
13.2 For ongoing or recurring services, the Company will notify the Customer of any material changes. Continued use of the services after such notice will constitute acceptance of the updated terms.
14. Severability
14.1 If any provision of these Terms and Conditions is found by a court or competent authority to be invalid, unlawful, or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable, or, if such modification is not possible, deleted. The remaining provisions shall continue in full force and effect.
15. Governing Law and Jurisdiction
15.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the laws of England and Wales.
15.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the services provided.
